Welcome to DMV Home Check ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our subscription-based residential asset management services, including our website, mobile applications, and all related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services. Please read these Terms carefully before subscribing to our membership plans.
DMV Home Check provides subscription-based home maintenance and management services to residential homeowners in the Washington, DC metropolitan area. Our services include, but are not limited to:
The specific services included depend on your chosen membership tier (Essential, Steward, Superintendent, or Estate). Details of each tier's inclusions are available on our website and will be confirmed during your onboarding process.
As a member, you agree to:
You represent and warrant that you are the owner of the property or have authorization from the owner to enroll the property in our Services.
Subscription Fees: Membership fees are billed monthly or annually based on your selected payment preference. Monthly subscriptions are charged on the same date each month. Annual subscriptions are charged in a single payment and include a discount equivalent to one month free.
Complexity Adders: Properties with special features (pools, generators, large acreage, etc.) may incur additional monthly charges as disclosed during onboarding.
Payment Methods: We accept major credit cards, debit cards, and ACH bank transfers. You authorize us to charge your selected payment method for all fees due.
Failed Payments: If a payment fails, we will notify you and attempt to process the payment again. Continued payment failures may result in suspension of Services.
Price Changes: We may adjust pricing with 30 days' advance notice. Existing annual prepay members will not be affected until their renewal date.
30-Day Money-Back Guarantee: If you are not completely satisfied within the first 30 days of your initial paid month, you may request a full refund of that first month's membership fee, no questions asked. To claim the guarantee, contact us at davit.avagyan@finopsys.org within 30 days of your first payment. This guarantee applies once per household and covers the base membership fee for your first paid month (including any complexity adders); it does not cover the Superintendent one-time onboarding fee for work already performed or charges for completed à la carte services.
Monthly Subscriptions: You may cancel your monthly subscription at any time with 30 days' notice. Your membership will remain active through the end of your current billing period.
Annual Subscriptions: Annual prepay members may cancel at any time. Refunds are calculated on a prorated basis for remaining full months, minus the annual discount already received.
How to Cancel: To cancel, contact us via email at davit.avagyan@finopsys.org or through your member dashboard. Cancellation requests must be received at least 30 days before your next billing date to avoid charges for the following period.
Effect of Cancellation: Upon cancellation, you will retain access to your digital home records. However, scheduled visits and other active services will cease at the end of your billing period.
Time Allocation: Each membership tier includes a monthly allocation of technician time ("Time Bank"). Essential and Steward tiers include quarterly visits only (no time bank). Superintendent tier includes 1.5 hours monthly. Estate tier includes 3 hours monthly.
Rollover Policy: Unused time bank hours roll over for up to 3 months. After 3 months, unused hours expire. Time bank balances reset to zero upon cancellation or tier change.
Usage: Time bank hours may be applied to minor repairs, additional inspections, and service coordination within your membership tier's scope. Hours are deducted in 15-minute increments.
Overage: If you exceed your time bank allocation, additional time is billed at $65/hour, charged to your payment method on file.
Visit Scheduling: Regular maintenance visits are scheduled based on your service zone's designated days. We will provide at least 48 hours' notice for scheduled visits.
Rescheduling: You may reschedule a visit with at least 24 hours' notice at no charge. Rescheduling within 24 hours may be subject to a $50 rescheduling fee.
Access Requirements: You must provide reliable access to your property for scheduled visits. If our technician cannot access the property after arriving, a missed visit fee of $75 may apply. Lockbox codes, gate codes, and alarm instructions must be kept current in your account.
Emergency/Urgent Visits: Emergency visits are available for safety-critical issues (water leaks, electrical hazards). Response times vary by tier: Steward (3-7 days), Superintendent (2-3 days), Estate (1-2 days). Emergency services outside normal hours incur premium rates.
Service Areas: We serve the Washington, DC metropolitan area including Montgomery County, Prince George's County, Fairfax County, Arlington County, and the District of Columbia.
Travel Tax: Properties located outside our core service zones may incur additional travel fees:
Travel fees are disclosed during onboarding and included in your subscription if applicable.
Included Materials: Basic consumables are included with your membership: standard HVAC filters (up to MERV 11), smoke detector batteries, and minor hardware (screws, caulk, weatherstripping).
Premium Materials: Specialty filters (MERV 13+, HEPA), smart home devices, and other premium materials are available at cost plus a 15% handling fee.
Repair Materials: Materials for minor repairs are generally included up to $50 per incident for Superintendent and Estate tiers. Materials exceeding this amount will be quoted for your approval before proceeding.
No Markup on Major Repairs: For Owner's Representative services, we do not mark up contractor quotes. You pay the contractor's quoted price directly.
Photo Documentation: Our technicians routinely photograph home systems and conditions as part of our documentation service. You may opt out of photo documentation in your account settings, though this may limit the detail available in your home health reports.
Video Documentation: Video documentation requires explicit opt-in consent. Video may be used for detailed system explanations or training purposes.
Sharing Your Dossier: Your Home Health Dossier contains comprehensive property documentation. When you share your dossier with real estate agents or other parties, your current consent settings are respected. Recipients see only what you have authorized.
Data Retention: Your property documentation is retained for the duration of your membership plus 3 years. You may request data export or deletion as described in our Privacy Policy.
Not an Appraisal: Any estimated values, savings calculations, or cost projections provided through our Services are for informational purposes only and do not constitute a professional appraisal or valuation.
Market Rate Comparisons: Our "market rate" comparisons are based on regional averages and may not reflect actual quotes from specific contractors. Actual costs may be higher or lower.
CapEx Projections: Capital expenditure projections are estimates based on typical asset lifespans and may not account for your specific circumstances. Actual replacement timing and costs may vary significantly.
Health Scores: Home health scores are proprietary metrics based on our assessment criteria. They are not endorsed by any government agency or industry standard body.
General Limitation: To the maximum extent permitted by law, DMV Home Check and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
Service Limitations: Our Services are preventive in nature. We do not guarantee that our inspections will identify all potential issues or prevent all property damage. We recommend maintaining appropriate homeowner's insurance coverage.
Maximum Liability: Our total liability for any claims arising from these Terms or our Services shall not exceed the amount you paid for Services in the twelve (12) months preceding the claim.
Third-Party Contractors: When we coordinate third-party contractors through our Owner's Representative service, we are not liable for their work quality, timeliness, or any damages they may cause. Contractors are independently licensed and insured.
Informal Resolution: Before initiating formal dispute resolution, you agree to contact us at davit.avagyan@finopsys.org to attempt to resolve any dispute informally. Most concerns can be resolved quickly through direct communication.
Binding Arbitration: If informal resolution fails, any dispute, controversy, or claim arising from or relating to these Terms or our Services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.
Class Action Waiver: You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or through our website at least 30 days before taking effect. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
